40,000 FISCAL YEAR 2005 H-1B NUMBERS ALREADY ALLOCATED

Employers should file new H1-B petitions now to secure one of only 18,200 remaining
for fiscal year 2005 or be prepared to go without for as much as 12 months
U.S. Citizenship & Immigration Services (CIS) recently announced that 40,000 of 58,200 H-1B numbers allotted
for Fiscal Year 2005 (October 1, 2004 through September 30, 2005) have already been allocated for new H-1B
petitions. The CIS may allocate all Fiscal Year 2005 H-1B numbers prior to the beginning of the Fiscal
Year on October 1, 2004.
As of August 4, 2004, only 18,200 H-1B numbers remain available for Fiscal Year 2005 H-1B petitions.
Given Congress's current reluctance to increase the cap for Fiscal Year 2005 H-1Bs, it is very likely that
Fiscal Year 2005 H-1B visa numbers will soon be exhausted. Therefore, employers considering filing new
H-1B petitions for beneficiaries abroad or individuals employed pursuant to F-1 optional practical training
are advised to do so at the earliest opportunity.
Some employers may wish to request premium processing of H-1B petitions in order to secure adjudication
within 15 days. However, because the CIS presently allocates H-1B numbers upon filing rather than upon
approval, premium processing petitions for the additional government filing fee of $1,000 is not as critical
to securing an H-1B number as is early filing.
To avoid potentially losing the opportunity to hire prospective new H-1B employees in the coming year,
